Maket Technologies Inc. (“Maket,” “we,” “us,” or “our”) is a Canadian technology company building an AI-powered platform for architectural design and visualization. Our mission is to democratize architecture by enabling anyone — from homeowners to professionals — to design, edit, and visualize conceptual floorplans and 3D renderings through an intuitive, AI-assisted experience.

We are committed to protecting your privacy, ensuring the security of your data, and maintaining transparency about how we collect, use, and share information.

Maket complies with applicable privacy and data protection laws in the Province of Québec and Canada, as well as international regulations such as the EU General Data Protection Regulation (GDPR), the UK Data Protection Act, the Swiss Federal Act on Data Protection, and relevant U.S. state privacy laws.

This Privacy Policy (“Policy”), available at https://www.maket.ai, describes how Maket collects, uses, stores, and discloses personal and technical information from various types of users (collectively, “Users,” “you,” or “your”), including:

  • Homeowners and individual creators using Maket to generate architectural concepts and visualizations;

  • Architects, designers, engineers, and building professionals using Maket for design assistance or client projects;

  • Developers, builders, and manufacturers collaborating with Maket through business or enterprise accounts;

  • Educational, research, or academic partners participating in training or pilot programs; and

  • Visitors, subscribers, and community members interacting with our website, communications, and marketing materials.

By using the Services, you acknowledge that you have read and understood this Policy.

Our legal basis for processing your personal information may include contract performance, legitimate business interests, user consent, and/or compliance with legal obligations, as outlined in Section 3 of this Policy.

This Policy forms part of our Terms of Service and, where applicable, our ‣ (DPA), which governs the handling of Customer Personal Data. If you do not agree with this Policy, please discontinue your use of the Services. In the event of any conflict between this Policy and a signed DPA, the DPA shall prevail with respect to Customer Personal Data.


1. Definition of Personal Data

For the purposes of this Policy, “Personal Data” (also referred to as “Personal Information” under the California Consumer Privacy Act / Privacy Rights Act (CCPA/CPRA) and other U.S. state privacy laws) means any information relating to an identified or identifiable individual, or that is reasonably capable of being linked to a particular person, consumer, or household, as defined under:

  • the EU General Data Protection Regulation (GDPR);

  • the UK GDPR;

  • Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA);

  • Québec’s Act Respecting the Protection of Personal Information in the Private Sector (Law 25);

  • the revised Swiss Federal Act on Data Protection (FADP); and

  • applicable U.S. federal and state privacy statutes.

Personal Data may include, for example:

  • your name, email address, or postal address;

  • your company name and professional contact information;

  • your telephone number, username, or account identifiers;

  • unique device IDs, browser fingerprints, or IP address;

  • authentication tokens, login credentials, or session metadata;

  • usage and telemetry logs associated with your account; or

  • any other information generated or collected through your use of the Services that can reasonably identify you or your organization.

Personal Data may also include biometric, genetic, geolocation, or special category data as defined under GDPR and equivalent international laws.

Operational metrics, telemetry, and service-level analytics that Maket processes independently — for example, for security monitoring, billing, fraud prevention, performance optimization, or product improvement — are referred to as “Service Data.”

Such Service Data is handled separately, in accordance with Section 8 (Data Retention and Security), and is not considered Customer Personal Data under this Policy.


2. Collection and Use of Information


Sensitive Data Notice

Maket Technologies Inc. does not intentionally collect special-category or sensitive personal data, such as biometric identifiers, health information, or precise geolocation data, and instructs users not to upload or include such information in any plans, files, or communications.

This definition shall include any equivalent category of data under privacy laws that may come into effect during the lifetime of this Policy.


Information You Provide Directly

When you create an account, subscribe to a paid plan, book a demo, request support, or otherwise use the Services, you may provide personal data such as:

  • your name, email address, phone number, or business contact information;

  • account credentials and authentication details;

  • billing and payment information, processed securely through Stripe (see Stripe’s Privacy Policy for details on how they handle card and transaction data); and

  • project-related content, including uploaded plans, images, renderings, or annotations, and AI-generated floorplans or visualizations created within your workspace.

For users on credit-based plans, Maket collects usage metrics (e.g., floorplans generated, renders created, AI requests, or processing time) to measure consumption against your available Credits.

These records are processed through Stripe and may include anonymized usage summaries for billing and audit purposes.

Maket does not store full payment card information; Stripe serves as the source of truth for billing records.

Uploaded or generated artifacts (e.g., floorplans, renderings, or project data) are used to provide your workspace, and—once anonymized or aggregated—may be used to improve Maket’s AI models, enhance user experience, and develop new architectural features.

Maket does not use identifiable user content to train third-party or general-purpose AI models without your consent.


Information Collected Automatically

When you interact with the Services, Maket automatically collects technical and usage data, such as:

  • IP address, browser type, operating system, and device identifiers;

  • pages visited, actions taken, timestamps, and error logs; and

  • session telemetry and performance data to maintain platform stability and security.

Certain operational metrics (“Service Data”) are processed by Maket as an independent controller for legitimate business purposes such as security monitoring, fraud detection, billing, analytics, and product improvement (see Section 8).


Usage and Analytics Data

Maket records interactions with the platform to understand how users engage with key features—such as plan generation, floorplan editing, 3D rendering, or visualizer tools—to improve overall performance and reliability.

If you choose to connect a third-party integration (e.g., data import, rendering engine, or storage provider), Maket accesses only the minimum data necessary to provide that integration and processes it in accordance with this Policy.


Data Handling and Third-Party AI Providers

Maket’s Services may transmit data to third-party AI providers to generate designs, visualizations, or text-based content.

When you use these features, your inputs (e.g., prompts, design parameters, or project details) may be temporarily transmitted to such providers for processing.

These transmissions occur on a pass-through basis and are processed under the privacy policies of the respective providers, including:

Maket does not store raw prompts or responses unless you explicitly save them in your workspace.

By using these AI-enabled features, you consent to such transfers under the applicable provider privacy terms.


Children’s Data

Maket’s Services are not intended for individuals under eighteen (18) years of age, and we do not knowingly collect or process personal data from anyone under this age.

If we learn that we have collected data from a minor without verifiable parental consent, we will promptly delete that information.

Purposes and Legal Bases for Processing

Maket processes personal data on the legal bases of contract performance, legitimate business interests, user consent, and legal compliance, for purposes including:

  • providing, operating, and maintaining the Services (including plan generation, rendering, and workspace management);

  • personalizing your user experience and improving AI-driven design suggestions;

  • analyzing feature usage to enhance product performance and reliability;

  • detecting, preventing, and investigating fraud, abuse, or security incidents;

  • communicating with you, delivering updates, and providing customer support;

  • processing payments, invoices, and transactions you authorize;

  • sending product updates, surveys, and promotional information (subject to your communication preferences);

  • complying with legal, regulatory, export-control, and sanctions obligations; and

  • fulfilling internal recordkeeping, accounting, and audit requirements.

Maket does not engage in automated decision-making that produces legal or similarly significant effects on individuals (as defined under GDPR Art. 22).

We collect only the minimum personal data necessary for these purposes and retain it according to the data retention schedule described in Section 8.

You may exercise your opt-out, deletion, or objection rights as outlined in Section 9 (“Your Privacy Choices”).


3. Legal Bases for Processing Your Data

Maket Technologies Inc. processes personal data only where a valid legal basis applies under the privacy frameworks governing your jurisdiction.

The specific legal basis we rely on depends on the nature of the interaction, your location, and the purpose of processing.

Applicable Privacy Frameworks

Maket complies with the privacy and data protection laws applicable to its operations, including:

  • Canada: Personal Information Protection and Electronic Documents Act (PIPEDA) and Québec’s Act respecting the protection of personal information in the private sector (Law 25);

  • European Economic Area (EEA): General Data Protection Regulation (GDPR);

  • United Kingdom: UK GDPR;

  • Switzerland: Revised Federal Act on Data Protection (rev-FADP);

  • United States: State privacy statutes including the California Consumer Privacy Act / Privacy Rights Act (CCPA/CPRA), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), Utah Consumer Privacy Act (UCPA), Connecticut Data Privacy Act (CTDPA), and any other U.S. laws in effect during your use of the Services.

Legal Bases We Rely On

  • Performance of a Contract:

    We process personal data to operate, maintain, and deliver the Services you have requested—such as generating, storing, or rendering architectural floorplans, managing your workspace, and handling payments—under our Terms of Service or other agreement with you.

  • Legitimate Interests:

    We use personal data to secure and improve the Platform, detect and prevent fraud or misuse, analyze aggregated usage, optimize AI-generated results, and conduct research and product development.

    These activities support Maket’s legitimate interests in maintaining a reliable, innovative, and efficient platform, and we ensure they do not override your fundamental rights and freedoms.

  • Consent:

    We rely on your explicit consent for:

    • non-essential cookies and analytics tracking;

    • marketing communications and promotional offers;

    • participation in user testing or feedback programs; and

    • data processing that requires consent under applicable law (e.g., optional AI personalization features).

      You may withdraw consent at any time without affecting the lawfulness of processing already performed.

  • Legal Obligations:

    We retain and disclose information as necessary to comply with legal duties, including bookkeeping, taxation, export control, sanctions, and lawful requests from public authorities or courts.

  • Protection of Vital Interests:

    In exceptional circumstances, we may process personal data to protect an individual’s vital interests—for example, to prevent physical harm, data loss, or respond to a security incident or emergency.


4. Purposes of Use and Processing

We use personal information to operate, maintain, and improve Maket’s AI-powered architectural platform and related services.

Your data is processed for the following business and commercial purposes, in accordance with applicable privacy laws:

Service Delivery and Support

To provide and maintain the Maket platform, including user authentication, generation of architectural floorplans, 3D renderings, and conceptual designs, as well as offering technical support and customer assistance.

Service Integrity and Security

To ensure the security, integrity, and reliability of our Services, detect and prevent fraud, abuse, or unauthorized access, and protect both users and Maket from potential cyber or data threats.

Service Improvement, AI Training, and Research

To analyze uploaded or generated data—such as floorplans, layouts, rendus, user prompts, and usage patterns—to:

  • refine and retrain Maket’s AI and generative algorithms,

  • enhance accuracy, contextual understanding, and architectural compliance,

  • and develop new features and user experiences.

Where feasible, such analysis is performed on anonymized or aggregated data that does not identify individual users or clients.

Personalization

To tailor your experience, including optimizing design recommendations, AI-generated layouts, and visual outputs based on your activity, preferences, and interaction history within the platform.

Product Updates and Limited Marketing

To communicate about new features, events, product updates, or promotional offers related to Maket’s Services.

This may include emails or notifications about credit-based plans, feature previews, or AI improvements.

Marketing communications are optional, non-transferable, and revocable at any time via your account settings or the unsubscribe link in emails.

Maket measures the effectiveness of such communications to improve relevance and engagement.

Business Continuity and Security

To maintain stable operations, backup systems, and disaster recovery processes, and to protect Maket’s intellectual property, software, and infrastructure.

Legal and Regulatory Compliance

To comply with applicable laws, regulations, export controls, and sanctions, as well as with lawful court orders, investigations, or privacy obligations in Canada, the United States, the European Economic Area, the United Kingdom, Switzerland, and other jurisdictions where Maket operates.

Auditing, Accounting, and Corporate Governance

To perform internal audits, maintain financial records, ensure corporate transparency, and meet reporting or governance obligations under applicable business and tax laws.

Dispute Resolution and Legal Defense

To establish, exercise, or defend legal claims, respond to disputes, and protect Maket’s rights, users, and property under applicable law.


5. Data Processing and Sub-Processors

Maket Technologies Inc. acts as both a data controller (for its own user accounts, analytics, and marketing activities) and a data processor (when processing personal data and project content on behalf of customers using the Maket platform).

When acting as a processor, Maket processes Customer Personal Data only in accordance with the customer’s documented instructions and any applicable ‣ (DPA).

Third-Party Sub-Processors

To operate and maintain our Services, Maket engages carefully selected third-party sub-processors who support essential business functions such as:

  • Cloud hosting and infrastructure management, including storage, compute, and database operations for the Maket platform;

  • Secure payment processing, through verified payment service providers such as Stripe;

  • User authentication, file storage, and backup systems;

  • AI model execution, via third-party AI providers (e.g., OpenAI, Google, or others integrated for AI-assisted generation and rendering features);

  • Technical support, customer service, and analytics, to improve reliability and performance;

  • Email and communication tools, for account notifications, service updates, and opt-in marketing communications.

Each sub-processor is bound by written contractual obligations that:

  • ensure data protection and confidentiality equivalent to those contained in Maket’s DPAs;

  • restrict sub-processors from using Customer Data for any purpose other than providing the contracted services; and

  • require security measures consistent with international privacy standards (GDPR, PIPEDA, Law 25, etc.).

Sub-Processor Transparency

Maket maintains a current list of authorized sub-processors, including their name, location, and processing purpose (for example, Stripe – billing and payment processing; Google Cloud – infrastructure hosting; OpenAI – AI text and design generation).

Customers are provided advance notice of any material sub-processor changes and may object within ten (10) business days if they reasonably believe such changes adversely affect data protection.


6. International Data Transfers

Maket Technologies Inc. is headquartered in Canada and may transfer personal information to other countries where our partners, infrastructure providers, or sub-processors operate — including the United States and jurisdictions whose privacy laws may not have been deemed “adequate” by the European Commission, the UK Information Commissioner’s Office, or the Swiss FDPIC.

These transfers are performed in compliance with applicable data-protection laws and safeguarded by one or more of the following legally recognized mechanisms:

Canada as an Adequate Jurisdiction

The European Commission has recognized Canada (commercial organizations subject to PIPEDA) as providing an adequate level of protection for personal data.

Accordingly, transfers from the EEA, UK, or Switzerland to Maket’s Canadian operations are permitted under Article 45 GDPR.

EU–US Data Privacy Framework (DPF)

Where data is transferred to the United States through our sub-processors or service providers (e.g., Stripe, Google Cloud, OpenAI), Maket relies—where applicable—on their certification under the EU–US Data Privacy Framework (and its UK and Swiss Extensions) to ensure compliant cross-border transfers.

EU Standard Contractual Clauses (SCCs)

For transfers not covered by adequacy or the DPF, Maket implements the EU Commission Standard Contractual Clauses (Decision 2021/914, Module 2 – Controller-to-Processor) within its ‣ (DPAs) with customers and sub-processors.

UK International Data Transfer Addendum

Transfers from the United Kingdom are governed by the UK International Data Transfer Addendum (Version B1.0) issued under Section 119A of the UK Data Protection Act 2018, used together with the EU SCCs.

Swiss Addendum

For transfers involving data subject to the revised Swiss Federal Act on Data Protection (FADP), Maket applies the EU SCCs with modifications naming the Swiss Federal Data Protection and Information Commissioner (FDPIC) as the competent authority and adapting jurisdictional terms accordingly.

Additional Safeguards

Maket conducts Transfer Impact Assessments (TIAs) when required to evaluate the legal and practical implications of cross-border data flows.

We also apply technical and organizational measures, including encryption in transit and at rest, strict access controls, and contractual guarantees requiring our partners to uphold equivalent levels of protection.


7. Investigations and Disclosures

Maket Technologies Inc. may access, preserve, or disclose personal information — including Customer Data — when legally required or when such action is taken in good faith and permitted by law, if we reasonably believe it is:

  • Necessary to comply with a valid legal process or governmental request, such as a subpoena, court order, law-enforcement demand, or other lawful request under applicable jurisdiction.

    Unless prohibited by law, Maket will notify the affected customer or user before disclosing any data, in accordance with our ‣ (DPA) and Standard Contractual Clauses (SCC) obligations.

  • Helpful to prevent, detect, or investigate fraud, security breaches, or other unlawful or harmful activity related to our Services, systems, or users.

  • Required to protect the rights, property, or safety of Maket, our employees, users, affiliates, or the public, including in cases of potential threats, abuse of the Services, or legal claims involving Maket’s operations.

All such disclosures are limited to the minimum scope necessary and are carried out in a manner that preserves confidentiality and complies with applicable data protection laws.


8. Log Data and Telemetry

When you use the Maket platform or related Services, Maket Technologies Inc. automatically collects certain operational telemetry (“Log Data”) to help maintain the security, performance, and reliability of our systems.

This data is used for diagnostics, analytics, fraud prevention, and product improvement, and may also assist us in meeting legal, security, or audit obligations.

What Log Data Includes

Log Data may include, for example:

  • Your device’s IP address and approximate geographic region;

  • Browser type, operating system, and version information;

  • Pages, modules, or APIs you access within the Maket platform (e.g., floorplan generator, light editor, or visualizer);

  • Actions taken, such as generating, editing, or rendering a project;

  • Timestamps, session duration, and interaction frequency;

  • Unique session or device identifiers (e.g., cookies, analytics tags, or authentication tokens);

  • Error messages, crash reports, or debugging codes; and

  • Other usage statistics related to feature performance and system health.

Purpose of Log Data Collection

Maket uses Log Data to:

  • monitor and secure the Services against unauthorized access, abuse, or disruption;

  • analyze system performance and optimize user experience;

  • investigate technical issues, bugs, or crashes;

  • detect patterns that may indicate fraud, misconfiguration, or malicious activity; and

  • generate aggregated, non-identifiable insights for improving Maket’s infrastructure and AI systems.

Privacy and Retention

All Log Data is processed in accordance with applicable privacy and data-protection laws, including PIPEDA, Loi 25, and the GDPR.

Disclosures of Log Data (e.g., to service providers such as analytics or infrastructure partners) are limited to what is strictly necessary to perform the above purposes.

Maket retains Log Data only for as long as necessary to achieve these purposes or as required by law, after which it is securely deleted or anonymized.


9. Cookies and Other Tracking Technologies

Maket Technologies Inc. and selected third-party partners use cookies, pixels, and similar technologies (“Cookies”) to operate, secure, and analyze the Maket platform and to enhance your overall user experience.

Cookies help us understand how users interact with the Services, improve product performance, and deliver relevant communications in compliance with applicable privacy laws.


Types of Cookies We Use

We deploy the following categories of Cookies:

1. Strictly Necessary Cookies

These Cookies are essential to operate the core functions of the Maket platform, such as:

  • user authentication and session routing,

  • fraud detection and security validation,

  • consent management, and

  • load balancing or localization.

They are processed on the basis of legitimate interests or contract performance and do not require prior consent.

2. Analytics & Performance Cookies

These Cookies measure feature adoption, diagnose errors, and monitor how users interact with the platform (e.g., floorplan generation, editor usage, rendering frequency).

They help us improve performance, stability, and user experience.

Maket uses:

  • first-party analytics tools (e.g., PostHog) for product insights; and

  • third-party analytics services, such as Google Analytics, and TikTok Analytics, to evaluate usage trends.

In jurisdictions such as the EEA, United Kingdom, and Switzerland, Maket obtains explicit prior consent before setting these Cookies.

In the United States, Maket respects opt-out signals (including the Global Privacy Control, or GPC) in compliance with the CPRA and equivalent state laws.

3. Functional Cookies

Functional Cookies remember your preferences and improve your interaction with the Services.

They may store:

  • language or regional settings,

  • platform theme (e.g., dark/light mode), and

  • UI layout or configuration preferences.

4. Marketing and Conversion Cookies

Marketing Cookies help us measure and improve the effectiveness of our campaigns through trusted partners such as:

  • TikTok,

  • Meta / Facebook, and

  • Google Ads.

These Cookies allow us to track conversion metrics, campaign performance, and audience engagement.

However, Maket does not sell or share Customer Personal Data for cross-context behavioral advertising as defined by the CPRA or other applicable laws.

Marketing Cookies require explicit consent in the EEA, UK, and Switzerland, and respect opt-out preferences in other jurisdictions.

Managing Your Cookie Preferences

You may manage or withdraw your Cookie preferences at any time by:

  1. Clicking the Cookie Preferences button in our Cookie Policy;

  2. Changing your browser settings to block or delete Cookies; or

  3. Enabling an authorized browser signal such as the Global Privacy Control (GPC).

Disabling non-essential Cookies will not affect the core operation of the Maket platform, but may limit analytics-based insights and personalization.

Retention

Cookie-derived identifiers are retained only for the period necessary to fulfill the purposes listed above and, for analytics Cookies, never longer than thirteen (13) months, after which they are deleted or irreversibly anonymized in compliance with applicable data protection laws.


10. Information Security and Accuracy

Maket Technologies Inc. is committed to maintaining the confidentiality, integrity, and accuracy of your personal and project information.

We apply industry-standard technical and organizational safeguards designed to protect your data against loss, unauthorized access, misuse, alteration, or destruction.

Our Security Practices

Data in Transit

All communications between your browser, API client, or application and Maket’s servers are protected by end-to-end encryption (HTTPS/TLS 1.2 or higher).

Data Storage

Customer data — including project files, uploaded images, and generated floorplans — is stored in encrypted databases and object storage systems with secure key management.

Where feasible, data is pseudonymized or anonymized to reduce re-identification risk.

Access Controls

We implement role-based access, least-privilege principles, and multi-factor authentication (MFA) to ensure only authorized personnel can access user or system data.

Access permissions are reviewed regularly to maintain compliance.

System Resilience and Backups

We perform continuous encrypted backups with industry-standard recovery objectives (RTO/RPO) to minimize downtime and data loss.

Critical systems are hosted on redundant infrastructure to ensure continuity of service.

Security Monitoring

Our infrastructure benefits from real-time monitoring, centralized logging, and automated alerting for suspicious or abnormal activity.

Audit logs are retained for up to one (1) year for forensic and compliance purposes.

Staff and Vendor Oversight

All Maket employees:

  • undergo background checks,

  • sign confidentiality and data-protection agreements, and

  • receive annual privacy and security training.

Third-party sub-processors (such as Stripe, Google Cloud, OpenAI, and others) are vetted and contractually bound to maintain equivalent safeguards and to process data only under Maket’s documented instructions.

Incident Response

Maket maintains an incident response protocol designed to identify, assess, and respond promptly to potential security or privacy events.

If a personal data breach is confirmed and is likely to result in a risk to affected individuals, Maket will notify those users and, where required, the relevant supervisory authorities within the timeframes required by law (for example, under Loi 25, PIPEDA, or the GDPR).

Notifications will include all information reasonably available at the time, and Maket will continue to provide updates as the investigation progresses.

Your Role

To help us protect your data and maintain the security of your account:

  • Keep your account credentials confidential and do not share your password or access tokens with anyone;

  • Enable two-factor authentication (2FA) through Google Account Security or other supported authentication methods when signing in to your Maket account;

  • Avoid uploading or sharing sensitive or unnecessary personal information in your projects or communications; and

  • Notify us promptly if you believe any information associated with your account is inaccurate, lost, or compromised, so we can take appropriate action.

Shared Responsibility and Third-Party Infrastructure

Maket’s Services rely on secure third-party infrastructure providers, including Stripe (for payment processing), Google Cloud / Supabase (for hosting and storage), and AI model providers (e.g., OpenAI and Google) for AI-based generation.

While Maket maintains rigorous safeguards, we cannot guarantee uninterrupted availability or absolute security of systems managed by these external providers.

Interruptions, latency, or data loss may occur due to provider actions or events beyond our control (force majeure).

Maket uses commercially reasonable efforts to notify you of any material security incidents affecting your data but disclaims liability for failures attributable to third-party providers, as described in our Terms of Service.


11. Retention of Your Information

Maket Technologies Inc. retains personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required by applicable law.

Retention periods depend on the type of data, the purpose of processing, and legal or contractual obligations that apply.

General Retention Purposes

We retain information as needed to:

  • provide, maintain, and improve our Services;

  • comply with legal, regulatory, and tax obligations;

  • enforce agreements, resolve disputes, or defend against potential claims; and

  • detect, prevent, and investigate fraud, abuse, or security incidents.

Customer Data and Account Deletion

  • Customer Data (such as uploaded plans, floorplans, renderings, or workspace content) is retained for up to ninety (90) days after account cancellation, unless a longer period is required by law or necessary for legal defense, fraud prevention, or compliance purposes.

  • Upon account termination or expiration (including forfeiture of unused Credits, as described in the Terms of Service), Maket will delete or anonymize Personal Data within thirty (30) days, except where data must be retained for legitimate business or legal reasons.

  • System backups may securely retain residual copies of deleted data for up to ninety (90) days before being permanently overwritten.

Data Deletion Requests

You may request deletion of your personal or project data at any time by contacting us at help@maket.ca.

Maket will process such requests in accordance with applicable data protection laws, including your right to erasure under the GDPR and Law 25.

Your interactions with these third-party services are governed by their own privacy policies and Terms of Service.

We encourage you to review those policies carefully before providing any personal data or connecting your Maket account to such services.

Maket is not responsible for the privacy, security, or data-handling practices of external sites, platforms, or providers that are outside of our direct control.

By using the Maket platform, you consent to receive transactional and administrative electronic communications from Maket Technologies Inc. — including, but not limited to:

  • Account alerts and security notifications;

  • Billing and payment confirmations; and

  • Service or policy updates required to maintain your account.

These operational messages are essential to the delivery of our Services and cannot be opted out of.

You may, however, opt out of non-essential marketing or promotional e-mails at any time by clicking the “unsubscribe” link included in such communications or by adjusting your preferences in your account settings.

Opting out of marketing e-mails will not affect the receipt of important service communications.

14. Governing Law & Venue

This Privacy Policy is governed by, and construed in accordance with, the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

If you reside in a jurisdiction that provides mandatory consumer protection or data protection rights under local law, those provisions will prevail to the extent they conflict with this Policy.

International Users

For residents of the European Economic Area (EEA), United Kingdom (UK), or Switzerland, international data transfers and related disputes are subject to the following frameworks:

  • EEA:

    Transfers rely on the EU Standard Contractual Clauses (SCCs) governed by Irish law, with the courts of Dublin, Ireland as the chosen forum.

  • United Kingdom:

    Transfers are governed by the UK International Data Transfer Addendum, subject to the laws of England and Wales, with the courts of London as the exclusive venue.

  • Switzerland:

Maket does not warrant the accuracy, completeness, or security of data processed by third-party services or contained in AI-generated outputs.

As described in our Terms of Service ,

  • you retain ownership of your Customer Data and AI Output, and

  • Maket retains ownership of its Usage Data, models, algorithms, and platform infrastructure.


15. No Design or Construction Advice

The Maket platform provides AI-assisted tools that can generate, analyze, or suggest architectural layouts, renderings, and design concepts, but these are not a substitute for professional architectural, engineering, or construction expertise.

You remain fully responsible for:

  • Reviewing, validating, and adapting any floorplan, rendering, or configuration generated by the platform before using it for design, permit, or construction purposes;

  • Ensuring that all outputs comply with applicable local building codes, regulations, and safety standards; and

  • Obtaining any required professional review, certification, or approval from a licensed architect, engineer, or authority having jurisdiction.

All AI-generated plans, layouts, and visualizations are provided for conceptual or illustrative purposes only and are not construction-ready drawings.

Reliance on these outputs is entirely at your own risk.

17. Residents of the United States, Canada, EEA, United Kingdom, and Switzerland

This section supplements the rest of this Privacy Policy and applies to individuals located in the United States (including California, Colorado, Connecticut, Virginia, Utah, Florida, and Nebraska), Canada, the European Economic Area (EEA), the United Kingdom (UK), and Switzerland.

Maket Technologies Inc. collects and processes the following categories of personal data when you use the Services:

  • Identifiers such as name, business email address, phone number, user ID, and IP address (city-level location only).

  • Commercial information such as subscription tier, project history, and purchase records. Full payment-card details are processed solely by our PCI-compliant provider (Stripe) and are never stored by Maket.

  • Internet or network activity, including log-in events, feature usage, design prompts, generated floorplans, and related telemetry.

  • Inferences drawn to personalize your experience and improve AI outputs.

  • Project-related information that you upload, such as plans, renderings, or configuration files.

  • Sensitive personal information is not intentionally collected, and users are instructed not to upload any data such as government identifiers, financial account details, medical records, or precise geolocation. Our Services are not designed to process such data, and we disclaim responsibility for it if submitted.

Your Privacy Rights

Depending on your location, you may have some or all of the following rights (subject to applicable legal limitations). You may exercise these rights by contacting us at info@maket.ca. Maket will verify your identity and respond within thirty (30) days, or longer if permitted under applicable law.

  • Right of Access and Portability: You may request access to or a copy of the personal data we hold about you.

  • Right of Deletion: You may request deletion of your personal data, subject to legal and operational exceptions.

  • Right of Correction: You may request correction of inaccurate or incomplete personal information.

  • Right to Withdraw Consent: You may withdraw consent for specific processing activities at any time.

  • Right to Opt Out: You may opt out of the sale, sharing, or use of your personal information for targeted advertising.

    Maket does not sell or share personal data as defined under U.S. or Canadian privacy laws.

Maket will not discriminate against you for exercising your privacy rights.

If you believe a request has been wrongly denied, U.S. residents may appeal within sixty (60) days by replying to our decision.

Rights in Customer Data

As described in our Terms of Service, you grant Maket Technologies Inc. a perpetual, royalty-free license to use your Customer Data (excluding identifiable personal data) for legitimate business and research purposes, including:

  • Operating and improving the platform;

  • Training, validating, and fine-tuning AI and machine learning models;

  • Generating benchmarks, analytics, and performance insights.

Maket does not use identifiable personal data for training third-party or general-purpose AI models without your explicit consent.

However, anonymized or aggregated data may be used indefinitely for system improvement, testing, or research.

You can opt out of having your Customer Data used for AI training, research, or reinforcement learning by contacting info@maket.ca or by subscribing to a Business or Enterprise plan that offers enhanced data-handling and privacy controls. Please review the data usage terms associated with your plan on our website or in your account settings, as eligibility and available controls may vary depending on your subscription tier.

Sharing with Third Parties

Maket shares limited Customer Data only as necessary to provide its Services, including:

  • Infrastructure Providers such as Supabase or other hosting and storage providers;

  • AI Providers such as OpenAI, Google Gemini, or OpenRouter, for prompt and output processing;

  • Payment Providers such as Stripe, for secure transaction processing and billing.

Each provider’s data handling is governed by its respective privacy policy.

Maket does not sell, rent, or trade your personal information to third parties.

For billing purposes, anonymized or aggregated usage data may be shared with Stripe.


18. Changes to This Policy

Maket Technologies Inc. reserves the right to update or revise this Privacy Policy at any time to reflect changes in our practices, legal or regulatory requirements, or the evolution of our Services.

Any revised version of this Policy will be posted at https://www.maket.ai, with the “Last Updated” and “Effective” dates clearly indicated at the top of the document.

If we make material changes that significantly reduce your rights or expand how we process personal data, we will provide at least thirty (30) days’ advance notice by email or through an in-product banner.

Your continued use of the Services after the effective date of the new Policy constitutes your acceptance of the revised terms.


19. Severability

If any provision of this Privacy Policy is determined to be unlawful, void, or unenforceable under applicable law, that provision will be interpreted as closely as possible to reflect the original intent of Maket and the user.

If such interpretation is not possible, the provision will be deemed severed, and the remaining provisions will continue in full force and effect.


20. Entire Agreement

This Privacy Policy, together with the Terms of Service, any applicable ‣ (DPA), and any supplemental product or plan-specific terms, constitutes the entire agreement between you and Maket Technologies Inc. regarding privacy and data protection in connection with the Services.

In the event of a conflict or inconsistency:

  1. the ‣ (DPA) will prevail with respect to Customer Personal Data;

  2. this Privacy Policy will prevail over the Terms of Service; and

  3. the Terms of Service will govern all other aspects of your relationship with Maket.
