Introduction
These Terms of Service (“Terms”) constitute a legal agreement between you and Maket Technologies Inc. (“Maket,” “we,” or “us”). Your use of maket.ai (the “Site”) and the services, software, and applications made available through the Site (collectively, the “Services”) is subject to these Terms.
By accessing or using our Site or Services, you:
Acknowledge that you have read, understood, and agree to be bound by these Terms;
Agree to our Privacy Policy ; and
Commit to comply with all applicable laws and regulations.
If you are accepting these Terms on behalf of a company or another legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Maket may update or modify these Terms at any time by posting revised versions on the Site or by notifying you directly. Your continued use of the Services following any such updates constitutes your acceptance of the revised Terms.
Definitions
When we use the following terms in these Terms, here’s what we mean:
“Account” means the user profile you create on the Maket platform to access and use our Services.
“Credits” means prepaid, non-refundable, and non-transferable digital units that can be used to generate, edit, visualize, or render architectural projects through the Services.
“Customer Data” means any floorplans, images, files, text, or other data that you upload, input, or generate through the Services. Customer Data does not include Usage Data or Maket Materials.
“Floorplan” or “Generated Floorplan” means a conceptual architectural layout automatically produced through the Maket Platform based on user inputs (such as land shape, program requirements, or area constraints). Generated Floorplans are intended for conceptual and visualization purposes only and are not construction-ready documents.
“Free Trial” means limited-time promotional access or credits that may be offered to you without charge to test the Services.
“Maket Materials” means the Site, the Services, our software platform, all related algorithms, templates, models, datasets, documentation, interfaces, user interfaces, and visual elements made available by Maket, as well as any improvements, updates, or derivative works. Maket Materials do not include Customer Data.
“Platform” means the Maket software environment (including the web application, APIs, and 3D visualization tools) that enables users to generate, edit, and render architectural plans using artificial intelligence.
“Services” means all tools, features, integrations, algorithms, rendering systems, and support provided by Maket through the Platform and Site.
“Site” means maket.ai and any associated domains or subdomains operated or controlled by Maket.
“Subscription” means a recurring paid plan that provides access to specific Maket features, credits, or services for a defined period.
“Third-Party Provider(s)” means independent companies or services (such as hosting, storage, rendering engines, or AI model providers) used by Maket to deliver its Services.
“Usage Data” means anonymized technical, analytical, or performance data automatically collected in connection with your use of the Services. Usage Data does not include Customer Data or personally identifiable information.
“You” or “User” means the individual or entity that creates an Account and uses the Services.
License to Use Our Services
Subject to your compliance with these Terms, Maket Technologies Inc. grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services — including the Platform and any Generated Floorplans — solely for your personal, professional, or internal business purposes, as permitted by your subscription plan.
This license does not grant you any ownership rights in the Services, the Platform, or any underlying algorithms, models, or datasets used by Maket. All rights, title, and interest in and to the Services and Maket Materials remain the exclusive property of Maket and its licensors.
You may use the Generated Floorplans and other outputs you create through the Services for conceptual, visualization, presentation, or client-related purposes, provided that such use complies with these Terms and applicable laws.
⚠️ Important Notice: The Generated Floorplans produced by Maket are conceptual designs only. They are not technical, architectural, or engineering documents, and cannot be used for construction, permitting, or regulatory approval purposes. Maket does not guarantee the accuracy, compliance, or constructability of any generated plan and shall not be held responsible for any damages, losses, or claims resulting from the use of Generated Floorplans for design, construction, or other real-world applications. Users are solely responsible for obtaining professional validation or certification before using any concept generated through the Services in a construction or design project.
This license automatically terminates if you violate these Terms or if your account or subscription is suspended or terminated for any reason.
License Restrictions
You agree not to, and not to allow others to:
Copy, modify, distribute, sell, lease, sublicense, or otherwise exploit the Services, the Platform, or Maket Materials except as expressly permitted in these Terms;
Resell, provide, or make the Services or Generated Floorplans available to any third party in a way that competes with Maket’s offerings;
Share your account credentials or allow unauthorized individuals to access your account;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive or replicate the source code, algorithms, datasets, or generation logic underlying the Services;
Circumvent or disable any security, credit usage, or access controls implemented by Maket;
Use automated tools (such as bots, scrapers, or crawlers) to access or extract data from the Platform without prior written authorization;
Upload, transmit, or distribute any malicious code, viruses, or harmful content through the Services;
Interfere with, overload, or disrupt the normal operation of the Platform or Maket’s infrastructure;
Use the Services to harass, impersonate, or otherwise harm other users or third parties;
Use the Services or any Generated Floorplans in violation of applicable laws, zoning regulations, or building codes;
Use the Services or any output generated by Maket for actual construction, engineering, or permitting purposes without review and validation by a licensed professional;
Represent or market any Generated Floorplan as a certified architectural or engineering document;
Use any Maket output, dataset, or prompt to train, develop, or improve a competing AI model, design system, or similar generative technology;
Misrepresent AI-generated content as human-authored in contexts where it could cause harm, confusion, or deception;
Remove, obscure, or alter any copyright, trademark, or proprietary notices contained in the Services or Generated Floorplans.
Violation of these restrictions may result in the immediate suspension or termination of your account and legal action where appropriate.
Project Links and Hosted Content
If you use our Services to create, share, or host content through links or pages under maket.ai (for example, maket.ai/project/your-name or maket.ai/view/xyz123), you acknowledge and agree that:
Maket retains full ownership of the maket.ai domain and all associated URLs or subpaths used to host, share, or preview your projects.
Maket reserves the right, at its sole discretion, to modify, redirect, suspend, or remove any shared project link or hosted content at any time and for any reason, including but not limited to:
Preventing confusion, impersonation, or misuse of Maket’s brand or platform;
Responding to reports of abuse, inappropriate, or unlawful content;
Managing inactive, expired, or underutilized project links;
Ensuring compliance with these Terms, our Privacy Policy , or applicable laws;
Maintaining technical stability, performance, or security of the Platform.
While Maket may, when reasonable, provide a 7-day notice before removing or redirecting a project link, it reserves the right to act immediately and without prior notice in cases of abuse, legal obligation, or urgent technical or security concerns.
You acknowledge that you have no proprietary or ongoing right to any specific URL, subpath, or hosted project link, and that Maket’s modification or removal of such links does not entitle you to any refund or compensation.
You should not rely on the permanent availability of any project link or hosted content, and are encouraged to export or back up your designs if long-term storage is required.
All shared or hosted content under maket.ai must comply with these Terms, including the “License Restrictions” and “Acceptable Use” provisions.
Suspension and Termination for Breach
Maket may suspend or terminate your account, your access to the Services, or any portion thereof at any time and without prior notice if we reasonably believe that you have:
Violated these Terms, including the License Restrictions or any other applicable policy;
Used the Services, Platform, or Generated Floorplans in a fraudulent, abusive, or unlawful manner;
Shared, resold, or otherwise misused your account or subscription;
Attempted to interfere with, damage, or gain unauthorized access to any part of the Platform or Maket’s infrastructure;
Used the Services or Generated Floorplans for real-world construction, permitting, or other regulated activities without proper professional validation.
Suspension or termination does not limit any other rights or remedies available to Maket under law or equity.
You remain responsible for all fees, charges, and obligations incurred up to the effective date of suspension or termination, and Maket will not be liable for any loss of access, data, or Generated Floorplans resulting from such actions.
Maket reserves the right to retain or delete Customer Data associated with terminated accounts in accordance with our Privacy Policy and data retention practices.
Billing & Payments
Subscriptions
You may access the Maket Platform under a free or paid plan, as described on the Site.
Paid plans are billed in advance on a monthly or annual basis and renew automatically unless you cancel your subscription through your account settings before the renewal date.
Subscription limits — such as the number of projects, credits, features, or user seats — are displayed on the Site and may change from time to time.
Except where required by law, all subscription fees are non-refundable, including in cases of early cancellation, unused Services, or partial billing periods.
Maket reserves the right to modify its subscription tiers, features, and pricing at any time, with notice provided to active users in accordance with applicable law.
Credits
Certain Maket features (such as floorplan generation, 3D rendering, or visualization) operate on a credit-based system.
Credits are prepaid, non-transferable, and non-refundable digital units that can be purchased individually or included in your subscription plan.
Free Credits: Maket may offer promotional or trial credits for evaluation purposes. Free Credits expire automatically at the end of the promotional period or when your free plan ends, whichever occurs first.
Paid Credits: You may purchase additional credits at any time through our designated payment processor (such as Stripe). Credits do not accrue interest and have no cash or stored-value equivalent.
Unless otherwise stated on the Site, unused Paid Credits will remain available as long as your paid plan remains active. If your plan is canceled, downgraded, or expires, any unused credits may be forfeited.
Payments and Invoicing
Payments for subscriptions and credits are processed through Stripe or another third-party payment provider selected by Maket.
By purchasing a subscription or credits, you agree to be bound by that provider’s applicable terms and conditions, in addition to these Terms.
Maket relies on its payment processor’s records for metering, invoicing, and account balances, and such determinations are considered final and binding unless a clear error is demonstrated.
Invoices are issued electronically and detail your subscription plan, credit purchases, and applicable taxes. You agree to maintain accurate billing information and authorize Maket or its payment provider to charge your selected payment method on a recurring basis.
No Refunds
All payments made to Maket are final and non-refundable, except where otherwise required by applicable law.
Credits and subscriptions represent only a limited, revocable right to access the Services and do not constitute deposits or financial instruments.
Taxes
All fees and prices are exclusive of applicable taxes, unless otherwise stated.
You are responsible for any applicable sales, VAT, GST, or other government taxes or duties, except for taxes based on Maket’s income.
If withholding taxes apply under your jurisdiction, you agree to gross up your payments so that Maket receives the full amount owed as if no withholding were applied.
Service Dependencies and Availability
Maket provides the Services — including the Platform, floorplan generation systems, rendering tools, and related features — through a combination of proprietary technology and third-party service providers. These providers may include, without limitation, cloud hosting platforms, data storage services, rendering engines, and artificial intelligence model providers.
Because Maket does not fully control these third-party systems, we cannot guarantee the uninterrupted availability, performance, or security of the Services.
You acknowledge and agree that temporary interruptions, delays, or technical issues may occur due to maintenance, upgrades, system overload, network failures, or failures of third-party providers.
Maket shall not be liable for any loss, damage, delay, or interruption resulting from:
failures or outages of third-party infrastructure or AI providers;
internet connectivity issues or power disruptions;
user error or misuse of the Services; or
circumstances beyond our reasonable control, including force majeure events such as natural disasters, cyberattacks, or regulatory actions.
Maket will make commercially reasonable efforts to restore access and resume normal operations as quickly as possible in the event of service interruption.
AI Use Disclaimer
The Services may use artificial intelligence models to generate architectural concepts, floorplans, 3D visualizations, text descriptions, or other related outputs (collectively, “AI Output”).
AI Output is automatically generated and may contain inaccuracies, inconsistencies, or other errors. It is provided for conceptual and visualization purposes only and should not be relied upon as professional advice or technical documentation.
You are solely responsible for reviewing, validating, and using any AI Output produced through the Platform, including outputs generated via:
Maket’s proprietary generative systems and models;
integrated third-party AI providers (such as rendering or model-generation services); or
any external model, plugin, or dataset you connect to the Platform.
⚠️ Important Notice: Maket’s AI Output — including any Generated Floorplan or 3D rendering — does not constitute architectural, engineering, or construction documentation.
Maket does not guarantee the structural, regulatory, or dimensional accuracy of any AI Output, nor its compliance with local building codes or professional standards.
Users must obtain independent review and validation by a licensed professional before relying on any AI Output for construction, permitting, or other real-world applications.
AI Output may be similar or identical to results produced for other users who provide comparable inputs or prompts. Maket does not guarantee uniqueness, ownership exclusivity, or freedom from third-party rights, and assumes no liability for the way any AI Output is used or interpreted.
Customer Data and Privacy
No Sensitive Data
You agree not to upload, input, or otherwise provide any sensitive or regulated data through the Services, including but not limited to health information, government identification numbers, financial account details, or biometric data.
The Maket Platform is not designed or certified to handle such categories of data, and Maket disclaims all responsibility for any consequences resulting from the submission of such information.
Use of Third-Party Infrastructure and AI Providers
Maket’s Services, including floorplan generation, rendering, and visualization, operate partly on third-party infrastructure providers (such as cloud hosting, rendering engines, and AI model services).
When you use the Platform, your inputs, uploaded plans, prompts, floorplans, and related data may be transmitted to and processed by artificial intelligence systems — including those developed by Maket and by external AI providers — for the purpose of generating architectural concepts, 3D visualizations, or similar outputs.
By using the Services, you consent to the necessary transmission, processing, and storage of your Customer Data to operate, improve, and support the Platform.
Rights in Customer Data
Except for Personally Identifiable Information (PII), you grant Maket Technologies Inc. a worldwide, perpetual, royalty-free, non-exclusive, and transferable license to use, copy, process, analyze, and modify your Customer Data, including:
Uploaded plans, images, or design files provided by you;
AI-generated floorplans, renderings, and related outputs created through the Platform; and
Feedback, interactions, and behavioral data related to your use of the Services.
This license enables Maket to use such Customer Data for the following legitimate business and research purposes:
Operating, maintaining, and improving the Services and Platform;
Training, retraining, fine-tuning, or validating machine learning and artificial intelligence models, including through reinforcement learning and human feedback;
Enhancing model accuracy, performance, compliance, and user experience;
Developing aggregated analytics, performance benchmarks, and usage insights; and
Conducting research, testing, and quality assurance activities.
Maket may reuse or process Customer Data — whether uploaded or generated — to improve its generative algorithms and systems, provided such use does not publicly disclose or identify you or your clients.
If you do not want your Customer Data to be used for AI training, research, or reinforcement learning, you may opt out by contacting Maket, subscribing to a Business or Enterprise plan that offers enhanced data-handling and privacy controls, or by consulting the data usage information associated with each plan as described on the Maket website or within your account settings.
Maket may retain and use anonymized or aggregated versions of Customer Data indefinitely for the purposes described above.
Even if your account is closed or deleted, Maket may continue to retain and use anonymized or aggregated Customer Data — including uploaded plans, AI-generated floorplans, and related metadata — for the purposes of training, improving, and validating its AI models, conducting research and analytics, or ensuring the security and integrity of the Services, in accordance with this policy.
Use of Personally Identifiable Information (PII)
Maket will not use identifiable PII for training AI or machine learning models.
We do not sell, rent, or share PII with third parties for marketing or advertising purposes.
However, Maket may anonymize and aggregate certain information, and once anonymized, such data may be used without restriction for analytics, research, or product improvement.
Retention and Deletion
Customer Data may be retained in anonymized or aggregated form indefinitely for research and operational purposes.
PII is retained only as long as necessary to deliver and support the Services, comply with legal obligations, prevent fraud, or resolve disputes.
Deleted data may persist temporarily in backups before being permanently removed.
Usage Data and anonymized information may be retained indefinitely.
Third-Party Provider Data Handling
Certain infrastructure or AI providers used by Maket may, under their own terms, process aggregated or anonymized usage data for operational or analytical purposes.
By using the Services, you acknowledge and agree to such processing to the extent necessary for Maket to deliver its Services.
Customer Responsibility
You are solely responsible for ensuring that your use of the Services, including the upload, processing, or sharing of Customer Data, complies with all applicable privacy, intellectual property, and data-protection laws in your jurisdiction.
You must ensure that you have all necessary rights and permissions to submit such data to Maket and to grant the licenses described in this section.
Refunds and Termination
Forfeiture on Termination
If your account or access to the Services is terminated by Maket due to a violation of these Terms, any remaining Credits — whether free or paid — will be forfeited immediately and may not be refunded, transferred, or reactivated.
If you cancel your account or subscription voluntarily, any unused Credits will remain available until the end of your current billing period, after which they will automatically expire.
If Maket terminates your account or access for reasons other than a breach (for example, for technical, security, or legal compliance reasons not attributable to you), any remaining Credits will be applied to outstanding fees up to the effective termination date, after which they will expire.
No Refunds
Except where required by applicable law, all payments made to Maket are final and non-refundable, including subscription fees, credit purchases, and partially used billing periods.
Credits and subscriptions represent a limited, revocable right to use the Services and do not constitute deposits or stored-value instruments.
Effect of Termination
Termination of your account or these Terms immediately ends your right to access and use the Services, including any stored projects or Generated Floorplans.
Termination does not affect any rights or obligations that, by their nature, should continue after termination — including, but not limited to, intellectual property rights, license limitations, disclaimers, limitations of liability, indemnification, and payment obligations.
Upon termination, Maket may retain anonymized or aggregated data derived from your Customer Data for research, analytical, or compliance purposes in accordance with our Privacy Policy.
Marketing and Promotions
Promotional Credits and Offers
From time to time, Maket Technologies Inc. may provide users with promotional credits, discounts, or temporary access to certain features of the Platform (for example, trial floorplan generation, rendering, or premium plan access).
Such promotional offers are provided at Maket’s sole discretion and may be modified, suspended, or discontinued at any time without notice.
Restrictions
Promotional credits and offers:
are non-transferable, non-refundable, and non-redeemable for cash or any other value;
may be limited to specific Services or features (for example, only floorplan generation or rendering tools);
expire on the date stated in the promotional terms or, if none is specified, at the end of your current billing cycle; and
may not be combined with any other discount, coupon, or promotion unless expressly authorized by Maket.
Marketing Use and Community Sharing
By using the Services, you grant Maket Technologies Inc. a non-exclusive, worldwide, royalty-free, and transferable license to use, reproduce, and publicly display non-confidential or anonymized content generated through the Platform — including Generated Floorplans, 3D renderings, and visual assets — for marketing, educational, and community purposes, such as:
showcasing design examples on the Maket website, in social media posts, or promotional materials;
presenting anonymized or aggregated user creations in case studies, presentations, or industry events; and
inspiring and informing other users within the Maket community.
Maket will not disclose or attribute any personally identifiable or proprietary project information without your explicit prior consent.
You may request removal of any specific image or project used for such purposes by contacting Maket in writing.
Revocation
Maket reserves the right to revoke, cancel, or adjust any promotional credit, offer, or community feature if we reasonably believe it was:
obtained fraudulently,
used in violation of these Terms,
published or shared inappropriately, or
granted in error.
Promotional access and marketing use are governed by these Terms, and any misuse may result in credit removal, account suspension, or termination of promotional privileges.
Affiliate Program Terms
By participating in Maket Technologies Inc.’s affiliate or referral program (the “Affiliate Program”), you agree to the following terms and conditions:
No Self-Referrals
Affiliates may not refer themselves, their own company accounts, or any entity under their direct control.
Self-referrals will be automatically disqualified and may result in termination of affiliate status and forfeiture of pending commissions.
No Brand Bidding or Unauthorized Advertising
Affiliates may not bid on “Maket,” “Maket.ai,” or any misspellings, variations, or combinations of the brand name in paid search ads (e.g., Google Ads, Bing Ads, or social media advertising).
Violations will result in:
forfeiture of all commissions for the month in which the violation occurred,
permanent exclusion from earning commissions on any users acquired through such activity, and
possible account suspension or termination from the Affiliate Program.
Affiliates are also prohibited from using search-engine ads or sponsored listings that redirect traffic to Maket through affiliate links.
No Spam or Misleading Promotions
Affiliates must promote Maket honestly and ethically. You may not:
send unsolicited email (“spam”) or post promotional content in unauthorized communities;
make false, deceptive, or misleading claims about Maket’s products, pricing, or features;
impersonate Maket or its employees; or
use unauthorized logos, trademarks, or marketing assets without written permission.
Affiliates found using misleading, manipulative, or deceptive tactics will have their accounts terminated and any pending rewards revoked.
Valid Conversions and Payouts
Affiliate rewards are issued only for valid, completed sign-ups or purchases that meet the eligibility criteria described in the current affiliate campaign.
Maket reserves the right to verify referrals, reject fraudulent or incomplete sign-ups, and adjust or withhold payments in cases of abuse or policy violation.
Commissions are payable only after validation and within the timelines stated in the affiliate dashboard or campaign terms.
Termination and Compliance
Maket reserves the right to revoke affiliate access, withhold commissions, and terminate participation in the Affiliate Program at any time if it reasonably believes that an affiliate has:
violated these Terms,
engaged in fraudulent, abusive, or deceptive conduct, or
acted in a manner inconsistent with Maket’s brand values or reputation.
All determinations made by Maket regarding affiliate eligibility, commission validity, and compliance are final and binding.
Ownership
Our Rights
Maket Technologies Inc. (and its licensors) owns all rights, title, and interest in and to the Services and Maket Materials.
This includes, without limitation, the Platform, the maket.ai website, all underlying software, infrastructure, models, algorithms, datasets, APIs, and rendering systems, and all improvements, updates, or derivative works thereof.
All trademarks, logos, and brand elements associated with Maket are the exclusive property of Maket Technologies Inc..
Except for the limited license expressly granted to you under these Terms, no rights or ownership in the Services or Maket Materials are transferred to you.
All rights not expressly granted are reserved by Maket.
Your Rights
As between you and Maket:
You own your Customer Data, including any files, plans, or information you upload to the Platform.
You also own the AI-generated outputs (such as conceptual floorplans, layouts, 3D renderings, and design visualizations) created through your use of the Services, subject to:
any third-party rights in the underlying models, datasets, or external providers used in the generation process; and
the usage and marketing license granted to Maket under these Terms (for platform improvement, research, and promotional purposes).
Generated Floorplans and other outputs are intended for conceptual and visualization purposes only and are not construction documents. Users remain solely responsible for validating any design before real-world use.
Usage Data
Maket owns all rights, title, and interest in Usage Data generated by or in connection with your use of the Services.
Maket may use such Usage Data — which does not include personally identifiable information — for any legitimate business purpose, including:
analytics and product improvement;
quality assurance and benchmarking;
development of new features and algorithms; and
monitoring and maintaining platform performance and security.
Feedback
If you provide feedback, suggestions, ideas, or recommendations related to the Services or to Maket’s business (“Feedback”), you agree that Maket may use, copy, modify, distribute, publish, or otherwise exploit that Feedback for any purpose, in any form, and through any medium, without restriction or compensation to you.
Maket has no obligation to keep Feedback confidential, and such feedback does not create any joint ownership or attribution rights.
Relationship Between the Parties
Nothing in these Terms transfers ownership of your Customer Data or AI-generated outputs to Maket, nor does it transfer ownership of the Maket Platform, models, or Services to you.
Each party retains full ownership of its respective intellectual property.
Disclaimers of Warranties
THE SERVICES — INCLUDING THE MAKET PLATFORM, ALL AI-GENERATED FLOORPLANS, 3D RENDERINGS, VISUALIZATIONS, AND ANY OTHER OUTPUT — ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
MAKET TECHNOLOGIES INC. AND ITS LICENSORS, PARTNERS, AND PROVIDERS MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SERVICES OR ANY RESULTS THAT MAY BE OBTAINED FROM THEIR USE.
TO THE FULLEST EXTENT PERMITTED BY LAW, MAKET DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MAKET DOES NOT GUARANTEE THAT:
THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF MALICIOUS CODE OR DEFECTS;
AI OUTPUT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR INTENDED USE; OR
ANY GENERATED FLOORPLAN OR VISUALIZATION WILL COMPLY WITH LOCAL BUILDING CODES, ZONING REGULATIONS, OR PROFESSIONAL STANDARDS.
⚠️ Important Notice:
All AI-generated floorplans, designs, and renderings are provided for conceptual and visualization purposes only. They are not technical, architectural, or engineering documents and must not be used for construction, permitting, or other regulated purposes without professional review and validation.
You acknowledge that you use the Services and all AI Output at your own risk, and that Maket shall not be liable for any consequences, damages, or losses arising from reliance on the information or materials generated through the Services.
Indemnification
You agree to indemnify, defend, and hold harmless Maket Technologies Inc., its affiliates, officers, directors, employees, agents, licensors, and partners from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable legal and attorney fees) arising out of or related to:
your misuse or unauthorized use of the Services, the Platform, or any AI-generated floorplans, renderings, or outputs;
your use of AI-generated content for construction, permitting, or any professional purpose without appropriate validation by a qualified professional;
your failure to comply with any applicable laws, regulations, or codes, including building, zoning, or intellectual property laws;
your breach of these Terms or of any applicable terms of a third-party service or provider used in connection with Maket;
any Customer Data or content you upload, submit, or generate through the Services, including claims that such content infringes, misappropriates, or otherwise violates the intellectual property or privacy rights of a third party.
Maket reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with Maket in asserting any available defenses.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAKET TECHNOLOGIES INC., ITS LICENSORS, PROVIDERS, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR PROJECT DELAYS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR THESE TERMS, EVEN IF MAKET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Without limiting the foregoing, Maket shall not be liable for:
any downtime, service interruption, or delay caused by third-party hosting, rendering, or AI infrastructure providers;
any errors, inaccuracies, or omissions in AI-generated floorplans, renderings, or other outputs;
any use of AI-generated content for construction, permitting, or other regulated activities without professional validation;
any loss, corruption, or deletion of Customer Data, except to the extent caused by Maket’s gross negligence or willful misconduct; or
any act, omission, or misuse by you, your users, or anyone accessing your account.
IN NO EVENT shall Maket’s total aggregate liability for all claims arising out of or related to the Services or these Terms — whether in contract, tort (including negligence), strict liability, or otherwise — exceed the total amount you paid to Maket for the Services during the twelve (12) months immediately preceding the claim, except where such limitation is prohibited by applicable law.
Term and Termination
These Terms take effect when you first accept them or begin using the Services, and will remain in force until terminated by either party in accordance with this section.
User Termination
User Termination
You may terminate your account and stop using the Services at any time through your account settings.
Termination will take effect at the end of your current billing period. You remain responsible for all fees and charges incurred up to the effective date of termination.
Any unused or remaining Credits will be forfeited as described in the “Refunds and Termination” section.
Maket’s Right to Terminate or Modify Services
Maket Technologies Inc. may, at its discretion:
terminate or suspend your account or access to the Services for reasons described in the “Suspension and Termination for Breach” section;
terminate your account for convenience, by providing reasonable advance notice; or
discontinue, modify, or restrict any portion of the Services, features, or plans, at any time, to reflect changes in technology, market conditions, or legal requirements.
If Maket terminates your access for reasons other than a breach, you will retain access until the end of your billing period unless otherwise specified.
Governing Law and Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to them, the Services, or your use of the Platform will be governed by and construed in accordance with the laws of the Province of Québec, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in Montréal, Québec, Canada, will have exclusive jurisdiction and venue over any dispute, claim, or proceeding arising out of or relating to these Terms or the Services. You irrevocably consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum or lack of jurisdiction.
All disputes must be brought on an individual basis, and not as part of any class, collective, or representative action.
You and Maket Technologies Inc. each waive any right to a jury trial in any legal proceeding arising from or related to these Terms or the Services.
Our failure to enforce any right or provision in these Terms will not constitute a waiver of that right or provision.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
Survival
The provisions of these Terms that, by their nature, are intended to survive termination — including those relating to intellectual property, Customer Data and privacy rights, AI use disclaimers, limitations of liability, indemnification, refunds and termination, and governing law and dispute resolution — shall continue in full force and effect following the termination or expiration of your account or these Terms.
All rights and obligations that accrued prior to termination shall likewise survive and remain enforceable.
Publicity Rights
If you are a business or professional entity (such as a company, studio, builder, or developer), you grant Maket Technologies Inc. a non-exclusive, worldwide, royalty-free license to use your name, logo, trademarks, and brand identifiers (“Marks”) solely for the purpose of identifying you as a customer or partner of Maket in:
Maket’s website and marketing materials;
client lists, investor or partner presentations;
social media posts, newsletters, and press releases; and
case studies, trade events, or other promotional communications.
Where applicable, and with your consent, Maket may also display representative images or anonymized visuals of projects created using the Platform, provided such use does not disclose confidential information.
You may revoke this license at any time by providing written notice to Maket. Upon receipt, Maket will make commercially reasonable efforts to cease using your Marks or project references in new marketing materials. However, Maket is not required to recall, remove, or destroy materials already printed, published, or distributed prior to such notice.
You represent and warrant that you have all necessary rights to grant this license and that Maket’s use of your Marks or project visuals, as permitted under this section, does not infringe or violate any third-party rights.
Copyright and DMCA Compliance
Maket Technologies Inc. respects the intellectual property rights of others and expects all users of its Services to do the same.
If you believe that any material made available through the Maket Platform infringes your copyright or other intellectual property rights, please submit a written notice to our designated copyright agent containing the following information:
Identification of the copyrighted work or other intellectual property right that you claim has been infringed;
Identification of the material that you claim is infringing, along with information reasonably sufficient to allow Maket to locate the material (for example, a project link, image reference, or file name);
Your contact information, including your full name, mailing address, telephone number, and email address;
A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law;
A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner; and
Your physical or electronic signature.

Repeat Infringer Policy
In accordance with the Digital Millennium Copyright Act (DMCA), the Canadian Copyright Act, and other applicable intellectual property laws, Maket Technologies Inc. has adopted a policy of terminating, in appropriate circumstances and at its sole discretion, the accounts of users who are determined to be repeat infringers.
Maket may also, at its discretion, suspend, restrict, or terminate access to the Services for any user who infringes or is suspected of infringing the intellectual property rights of others, even if such user has not been formally deemed a repeat infringer.
Eligibility
You may use the Maket Platform and Services only if:
You are at least eighteen (18) years old or the age of majority in your jurisdiction and have the legal capacity to enter into a binding contract.
The Services are not intended for individuals under the age of eighteen (18), and Maket Technologies Inc. does not knowingly collect or solicit personal data from anyone under this age.
If Maket becomes aware that it has inadvertently collected personal information from a minor without verifiable parental consent, that information will be promptly deleted.

Exception — Educational or Supervised Use:
If you are under eighteen (18) and participate in a school, educational, or organized event under the supervision of adults or facilitators, you may use the Services only if Maket has been notified in advance and has set up specific secure access policies for such supervised participation.
By using the Services, you represent and warrant that you meet these eligibility requirements.
If you are using the Services on behalf of a company, organization, or other entity, you further represent that you have the authority to bind that entity to these Terms.

We may provide notices to you (including changes to these Terms, updates to our Services, or other important information) by:

Notices are deemed given when they are sent or published, unless a different time frame is required by applicable law.

Miscellaneous
Entire Agreement
These Terms constitute the entire agreement between you and Maket Technologies Inc. regarding the Services and supersede all prior or contemporaneous agreements, communications, and understandings (whether written or oral) relating to the Services.
Assignment
You may not assign, delegate, or transfer these Terms, in whole or in part, whether by operation of law or otherwise, without Maket’s prior written consent.
Maket may assign, delegate, or transfer these Terms, in whole or in part, without restriction and without notice to you.
Any attempted assignment in violation of this section shall be null and void.
Export Controls and Sanctions
You may not use the Services if you are located in, or acting on behalf of a person or entity located in, a country or territory subject to Canadian, U.S., or international export controls or sanctions (including, without limitation, Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk, or Luhansk regions of Ukraine).
By using the Services, you represent and warrant that you are not subject to such restrictions and that your use complies with all applicable export control and sanctions laws.
Beta or Experimental Features
From time to time, Maket may make certain beta, preview, or experimental features available to you.
Such features may be incomplete, unstable, or modified at any time, and may be discontinued without notice.
They are provided “as is”, without warranties of any kind, and may be subject to additional or separate terms.
Waiver
Maket’s failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that or any other provision at a later time.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
